These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.
1. Only open to UK residents aged 18 or over, excluding (a) employees of EMMI UK LIMITED or its holding or subsidiary companies; (b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the promotion or its administration; or (c) members of the immediate families or households of (a) and (b) above.
2. Main Promotion opens at 10:00 BST 01/05/2023 and closes at 23:59 BST 31/07/2023.
3. Wrap Up Draw opens at 00:00 BST 01/08/2023 and closes at 23:59 BST 30/09/2023.
4. All entries received outside the promotional periods will not be accepted.
5. Internet access required.

Winners selected via winning moments and entrants will be notified immediately if they have won, what prize they have won and next steps to claim their prize.

11. Entrants who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.
12. Entries (bulk or otherwise) made from trade, syndicates, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is reposting the same content multiple times or using a computer(s) to circumvent this or any other condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s entries will be disqualified and any prize award will be void.

14. There is a total of 460 Winning Moments available. 5 prizes available to be won each day of the main promotion period. All prizes will be won, except if the number of prizes exceeds the total number of valid entries received so there is no guarantee all prizes will be won in the main promotional period. Prizes will be randomly distributed via Winning Moments (pre-determined random time slots specified by day, hour, minute, second) set between 10:00:00 BST 01/05/2023 and 23:59:59 BST 30/07/2023 by a secure, independently verified computer programme. If your time of valid entry is the first to fall on, or after, a Winning Moment, you win the prize randomly pre-allocated to that Winning Moment. If two entries are received at the same time, the entry processed by the server first will be the winning entry. Any prize not won before the next Winning Moment will be rolled over into the next Winning Moment and be available to be won then. Any prizes not won during the main promotional period will be added to the Wrap Up Draw.
Main Promotion Winner Notification
15. Winners will be notified instantly on screen when they enter if they have won a prize, what prize they have won and next steps to claim their prize.
Main Promotion Prize Delivery
16. On notification, winners will be required to enter their postal address for prize delivery, the name they would like their prize to be personalised with up to a maximum of 12 characters, prize colour from the options available and, for phone case winners, phone model from the options available. The Promoter does not accept any responsibility for incorrect information provided. If a Main Promotion winner does not provide all the required information immediately, a reminder email will be sent by the Promoter to the email address supplied during entry and the winner will have 14 days to reply with the required information. If this is not received after the 14 days, the prize will be reallocated to the Wrap Up Draw and a new winner picked.
17. On completion of the on-screen instructions winners will receive a confirmation of their prize via the email address used to enter the Promotion. Winners should check their spam / junk email account folders during this period.
18. Prizes will be delivered by tracked mail within 28 days from win notification and completion of the claim process and any verification process. In the unlikely event that the prize does not arrive within the 28 day period, a winner will have a further 7 days to inform the Promoter by email to caffelatteloveisland@promotioncustomerservices.com. In the event that a winner does not inform the Promoter within this time frame, the Promoter reserves the right not to reissue the prize. Due to industry-wide supply chain issues, there may be unforeseen delays to deliveries of prizes. We will endeavour to get products delivered to winners as quickly as possible in event of any delay.
Wrap Up Draw Prizes
19. Official Love Island Personalised Phone Case (see Clause 13 for full details).
20. 5 Prizes to be won. Any prizes not won in the main promotional period will also be included in the Wrap Up Draw.
Wrap Up Draw Winner Selection
21. Winners will be randomly selected from all valid entries during the Wrap Up Draw promotion period using a verifiably random computer process on 06/10/2023.
Wrap Up Draw Winner Notification
22. Winners will be contacted via the email address used to enter within 7 days of winner selection. Entrants should monitor their email accounts during this period, including junk and spam folders, in case they are a winner.
23. Winners will have 14 days to:
- accept their prize;
- provide their postal address;
- choose the name they would like their prize to be personalised with up to a maximum of 12 characters;
- select the colour of their phone case (see Clause 12 for available colours); and
- select the model of their phone case from the available list.
24. The Promoter will make a maximum of 3 attempts to contact winners during the 14 day period.
25. In the event a winner does not respond to the initial contact within 14 days, is ineligible, rejects the prize or unable to take their prize for any reason, the Promoter reserves the right to disqualify that winner. If a winner is disqualified, the Promoter reserves the right to award the prize to a reserve selected in the same manner as detailed in clause 21. Reserve winners may have less time to respond. The process will repeat until an eligible winner is able to claim the prize.
Wrap Up Draw Prize Delivery
26. Prizes will be delivered by tracked mail within 28 days from the date each winner confirms the information as detailed in Clause 23 and the completion of any verification process. In the unlikely event that the prize does not arrive within the 28 day period, a winner will have a further 7 days to inform the Promoter by email caffelatteloveisland@promotioncustomerservices.com. In the event that a winner does not inform the Promoter within this time frame, the Promoter reserves the right not to reissue the prize. General Terms and Conditions
27. ITV is not responsible for the administration of the promotion.
28. All prizes are non-transferable or exchangeable and cannot be redeemed for any cash or any other form of compensation except that in the event of circumstances outside of its control the Promoter reserves the right to substitute a similar prize, or part of a prize, of equal or greater value.
29. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on acceptance of a prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.
30. Data Protection: The personal data provided by entrants to the Promoter will only be used by the Promoter for the purpose of conducting the promotion and at all times in accordance with the Data Protection Act 2018 and the Promoter’s Privacy Policy. Data will be stored for 3 months after each closing date of each promotion period before deletion. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to dataprotection.uk@emmi.com. By participating in the promotion, you agree to the use of your personal data as described here.
31. The Promoter accepts no responsibility for incomplete, illegible, incorrectly submitted, corrupted or misdirected claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure, any technical reasons or otherwise. Proof of sending will not be accepted as proof of delivery.
32. If for any reason any aspect of this promotion is not capable of running as planned due to events outside of the Promoter’s reasonable control, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries (this includes, without limitation, by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion). If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
33. The Promoter reserves the right to verify all winners including but not limited to asking for proof of address and ID (passport, driving licence or equivalent). The Promoter reserves the right to refuse to award a prize or withdraw offer entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, the spirit of the promotion, any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating or won using fraudulent means.
34. The Promoter will make available a list of winners’ surnames and counties from each promotional period to members of the public or regulators who request such details within 3 months of the closing date of each promotion period. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting info@uk.emmi.ch. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. You may request a copy of the winners list by emailing info@uk.emmi.ch. We reserve the right to refuse such request.
35. The Promoter will send full details of the Winning Moments selection process and the Wrap Up Prize Draw random computer process used to pick the winners to anyone who emails info@uk.emmi.ch within one month after the closing date of the wrap up draw promotional period requesting details.
36. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion, except for any liability which cannot be excluded by law (including personal injury or death due to negligence, and fraud) in which case that liability is limited to the minimum allowable by law.
37. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a claimant’s participation.
38. The Promoter’s decision in all promotional matters is final and no correspondence will be entered into.
39. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
40. Entrants’ statutory rights are not affected.
41. The Promotion and these Terms (including any non-contractual disputes or claims arising out of them) are subject to the law of England and Wales. Any disputes must be referred to the English and Welsh courts. Consumers in Scotland and Northern Ireland may additionally bring an action in their home courts.
