  • Thanks for all of your advice. I certainly feel less anxious about it all now. But what waste of everyone's time and energy all of this is, when inevitably, it seems, it'll all come to nothing! 
  • Have you tried Plan A as explained in the NEWBIES thread, which is basically a complaint to the landowner.

    Also as B789 says, if the claim is well defended, this dubious scamming duo tend to discontinue before it reaches court.
    No, not to this point. Having read that, I assumed I was beyond that point now. I'm willing to explore that as an option though if you think it would still be helpful
  • Just to update those who helped with this. After filing my defence, I have today received a letter from DCBL inviting me to call them and discuss a settlement:

    "We write in relation to the above matter.

    In order to assist the Court in achieving its overriding objective, our Client may be prepared to make an offer to conclude this matter. A settlement at this stage would avoid further potential costs being incurred. We therefore ask that you call us on 0203 838 7038 as soon as possible to discuss this further.

    We look forward to hearing from you."


    I'm assuming this is there final play and it's best to ignore?

    Ignore. Just as expected. The next step will be a notice of discontinuation.

    That letter is already mentioned in the first 12 steps in the Template Defence thread.  No need to assume!

  • I received the acknowledgement of filing my defence back on 22nd May this year. I'd heard nothing since then (other than requests to settle outside of court - which I ignored). The claim was then presumably stayed, as I've just logged into my MCOL to find the stay has been lifted on 16/8/23 and DQ issued. Does this mean the claimant is now unlikely to discontinue? Also, we haven't had a functioning postal service here recently, so the N180 form may take days/weeks to arrive. What is the usual deadline for returning the form?

    I think you get 28 days (correct me if I'm wrong, someone) but why not download one this week and then follow what the NEWBIES thread tells you about answering the questions?

    A stay being lifted is normal stuff and doesn't affect the likelihood of discontinuance at WS bundle stage.

    Just to update those who track these things, UKPC Ltd have now discontinued court procedings. I did initIally get a Notice of Allocation to the Small Claims Track (10/2/24), followed by a direct communication with an offer to settle but on 28/3/24 I received an email from DCB Legal notifying me of the discontinuance. Pleased it is finally all over. Thanks for the advice!
