Not happy with item condition - undisclosed - opinions needed

Hi all, I bought a nintendo 3DS XL in 'very good used condition'. The photos don't show the screen on or even the lid of the item very clearly however as it was white I assumed it would suitable. I recieved the item and noticed a fair amount of scratches on the lid, I think this is acceptable. However, I have noticed the top screen has a bright spot near one corner which is usually a sign there is a bunch of dead pixels. I'm not sure what to do - if this was disclosed I wouldn't have bought it - thoughts? The spot can be seen just under the word 'adjust'. I paid £100 for it.

Is that spot visible while playing games etc too? Can you try to massage it out? Sometimes this reactivates dead pixels....
Either way, you could always put it to the seller to see whether they can provide a partial refund?? It's completely possible the seller hasn't seen it, or isn't aware of what dead pixels etc are......
If you do this keep all messaging within the eBay messaging system, as well as the partial refund etc
You could just go ahead and open an 'Item Not As Described' case. Do not open any other case at all as you only get the one chance. Once this case is opened all communication will happen between you both within the case notes - this makes it easier for eBay reps to see what's happened etc in the one case shoudl it be referred to them - the seller can offer a partial refund here as well, or failing that would need to provide you a pre-paid label for the return, after which a full refund would be made.1
