PCN at Matisse road Hounslow. PPS (London) Ltd & Gladstone solicitors
I’m currently in the middle of a dispute with Gladstone Soloctiors acting on behalf of Private Parking Soutions (London) Ltd.
The time stamps on the 3 photos by the warden who I did not see in person shows me I was there from 13:58:29 until 13:58:51.
The vehicle is not mine and was a company vehicle, my boss has pressured me into responding as to clear any liability away from the company as soon as a CCJ was mentioned.
They have responded with the following -
Hi Bethany,Good Afternoon,
Thank you for your correspondence and apologies for the delay in responding.
By way of background this charge was incurred on the 19/01/2022 at our clients site Zone A B Holloway Street. Issued to the vehicle bearing the registration XXXXX, due to parking in a no parking area, breaching the contractual terms and conditions of the site.
Please see attached evidence in support of our position.
We note the content of your recent correspondence, however, this does not absolve you of liability regarding this charge.
We draw your attention judgment of Vehicle Control Services Ltd v Nick Idle and Vehicle Control Services Limited v Damen Ward considered by His Honour Judge Saffman (2018), whereby it was found “as regards to the reason for the stoppage and its duration, he argues that the breach occurs when the vehicle is brought to a standstill. It does not cease to be a breach simply because the car is stationary for a short period. It is the process of bringing the car to a standstill that creates the breach. In the absence of a provision which sets out the consequences for breach, such as there is here, then the duration of the breach maybe a factor in deciding what damages are payable but it does not alter the position that there has been a breach. I remind myself that in Vehicle Control Services Ltd v Crutchley the motorist for no more than 30 seconds and the observations by Lord Neuberger in Beavis.”
Our clients signage is clear in stating the contractual terms and conditions all motorists must adhere to upon entry of our clients site. Your vehicle is observed to be in breach of the stated, therefore incurring the parking charge.
Our client remains satisfied this charge was correctly issued and you are liable.
Should full payment fail to be discharged before the 28th April 2023, our client reserves the right to issue further legal proceedings against you without further notice.
I have since responded today and said -
Would anyone be able to shed a bit of light on how this now may play out?
Thanks

Same car park came up recently in this thread

Worth having a read of that.

Would anyone be able to shed a bit of light on how this now may play out?No different than any other Gladstones thread.
I'd search and read at least a dozen Gladstones threads from this past year.
Post 2 of the NEWBIES thread tells you what to expect and exactly what to do at LBC, then court stage.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top of this/any page where it says:

To fully understand what you have said here: "Should this case be thrown out, I will be seeking to recover costs for my time spent dealing with this alleged offence and also any other necessary cost involved in this matter." you need to have a thorough read of the Newbies/FAQ thread. You will have to spend a bit of time digesting that thread and keep referring back to it every time you have a question. You must use it as a reference.
As @Boat_to_Bolivia has stated above, you should read the linked thread about the exact same location and PPC.4
