Euro car parks appeal rejected

my daughter had a puncture on her car which was parked in Cheltenham North car park at just after midnight, she paid for a days parking because not knowing how long it would take to fix. I went with my son at 7.20am to sort out puncture as there is no spare wheel in car so had to take wheel off, went to get new tyre put on rim and returned to put wheel on car, because I took 13 minutes to sort wheel out I was issued with a parking ticket for MY vehicle which I didn't pay for parking, I appealed explaining all this and forwarded invoice for tyre on that day but they rejected appeal and stated I pay £60 or £100 after 14 days or appeal with POPLA - do I pay £60 or does anyone think it a Good idea to appeal with POPLA thanks in advance

We never advise anyone to pay these scammers. I hope you didn't reveal the drivers identity in your appeal.
The £40 discount is just a bribe to get gullible victims to pay them something rather than nothing.
Is Cheltenham North car park a railway station car park?
You must read the Newbies/FAQ thread near the top of this forum and keep referring back to it as a reference every time you have a question.
This is defendable as you were there dealing with a small vicissitude as described in this case which was an appeal case and has influence on the lower courts:

Plan A was always to complain to the landowner and also write to your MP asking him/her to complain to ECP.
Plan B was your appeal to ECP but that has failed and you may have given away the identity of the driver which we cannot do much about now.
Plan C is your POPLA appeal but even if you don't win that you move on to Plan D which is where you get to have a truly independent arbiter, a judge, deal with your case. However, you are dealing with ECP who you can almost certainly rely on to eventually drop it after they have no luck with the debt collector scare letters which you can safely ignore.
To win at POPLA you can only argue points of law or contract. Mitigation has no relevance for them. Have a read of the POPLA thread at the top of the forum as there were several cases recently where the appeals were won because of ECPs !!!!!! signage.1 -

Search the forum for Euro POPLA DECISIONS and (as an alternative) ECP POPLA DECISIONS
Change the search to NEWEST (never 'best match').PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
