I live in Scotland and have an outstanding charge for a PCN of £170 for “non-payment” at first I received letters from Trace Debt Recovery, who have now handed this over to ShakespeareMartineau, will they actually take me to court if I dont pay?

Hello and welcome.
It won't be worthwhile for anyone to take you to court in Scotland for £170.
Ignore them.2 -
Are they by any chance acting for Parking Control Management Ltd, or another company with a (very) similar but not identical name?
On other threads, Shakespeare Martineau seem to have a problem getting the name of the client right.
In any case, ignore them in Scotland.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks1 -
Transport (Scotland) Act 2019:

Basically, very similar to PoFA 2012 but I don't think it's been enacted yet.
