My next dilemma is if to accept mediation now. My view is what harm can it do? If I don't come to a middle ground I can proceed to court??
For now, having seen the defendants defence, you have to decide whether you wish to proceed with the claim. At some stage, you will have to submit your N180 DQ as will the defendant. After that, your case will be reviewed and allocated to a track and most likely to the a court local to the defendant and a hearing date assigned. Once the hearing date is assigned, both you and the defendant will be given a date by which you must submit your "bundle" which includes your witness statement and evidence to support your claim and the defendants WS and evidence.
Which stage are you currently at?
I'm just at the stage now where I need to say if I will go with mediation or not. I will proceed with mediation as this whole claim is just a firm saying they will do something and then didn't follow through with it despite it being on email multiple times.
Thank you again0
