Prescription penalty charge and exceptional reasons

Hi, I picked up a prescription on the 25th of November last year, and whilst I was in the pharmacy I purchased an annual prepayment prescription as I’d been put an another medication so it made sense (I normally pay the normal charge), it transpires that I accidentally selected 12 for the month and not 11 - so subsequently received a penalty charge.  I e-mailed the appeal address immediately, and told them what had happened, and asked if I could pay the prescription charge. I was told that I have to pay the penalty.  At this point I sent an appeal email, using the grounds for appeal as stated on the penalty charge notice:
there is an exceptional reason why you should not pay the penalty charge, and you can show that you did not act wrongfully or with any lack of care.

I have ADHD which affects me cognitively, and vulnerable to making mistakes with accuracy.  As I purchased a prepay certificate, I clearly did not act wrongfully, but they say that they won’t overturn it.  They say the exceptional reasons are for financial reasons or vulnerability.  

Does anyone know if I just need to pay the penalty notice (which is now £80) or I should continue fighting it.  

It feels like I am being penalised for having ADHD.  I am very much a rule follower and this is causing me no end of anxiety!

    Vulnerability would seem to be an appropriate basis for them to overturn the charge. You are vulnerable due to your ADHD. If they won't, you can make a formal complaint, and I would recommend that you engage your MP at this stage in case they don't overturn it when you make a formal complaint.  
    The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.

    Logically the purchase date of your prescription and the purchase date of the prepayment certificate should clearly show it was a slip of the finger rather than a deliberate attempt at fraud.  I don't know how you fight it though, maybe the CAB could help if you need it?
  • I feel you will need to show proof, as I expect they get many appeals, so will want to see evidence.
    Can you show them proof of your disability and how it affects you, Examples of past mistakes due to your disability will help I think.
