Car parking fine

Hi
Visited the lake district last week and went to White Moss car park. There was no spaces so we drove around the car park for 25 minutes waiting for a space. We never managed to get parked so gave up, left the car park and went elsewhere.
We have now received a car parking fine for £100 (reduced to £60 if we pay within 14 days) as there was automatic number plate recognition.
I have 2 questions
1. Do you think we have grounds to appeal?
2. If we appeal, will the £60 discounted fine be removed and we will have to pay the £100 fine?
The website is www.initialparking.co.uk - they say they won't speak on the phone (so can't call to ask question number 2) and I can't find any clear info on their website.
Thanks

Never phone a PPC and this is a speculative invoice, not a fine.

Welcome. We never advise paying these bottom-dwelling scammers a penny. The bribe "discount" is there because the scammers would rather get some money from their gullible victims than the possibility of nothing if it goes to their supposedly "independent" appeals service or it ever goes to court.
1. Do you have grounds to appeal? Of course you do and you should. However, do not, ever, phone the parking company. Every communication you have to do with them or, eventually, their solicitors, should be in writing, preferably by email as that contains much evidence of the date and time of sending, receipt etc.
2. As I stated above, you should ignore the bribe. You shouldn't have to pay anything; that is where the advice on this forum comes in.
Is this the location? https://goo.gl/maps/AyVT473tPow9rEHj7
If so, the signage is pretty poor and it is that signage that forms any contract. I can't even make out who the operator is. Is the PCN you received PoFA compliant? Do not, under any circumstances, reveal who was driving. If the PCn is not PoFA compliant, they cannot transfer liability for it to the RK.
ANPR does not evidence "parking".
Please have a good read of the Newbies/FAQ thread near the top of this forum to understand better the process and where you are in it. You should refer back to that thread often as it is your main reference. There is also a handy list of the abbreviations used here.5 -
As above, you should complain to the land owner in the first instance making sure that you remind them that they are liable for the actions of their agents of they try and pass the buck.
You should also look at the waiting is not parking case/ cases one of which is here http://parking-prankster.blogspot.com/2014/03/waiting-for-space-is-not-parking.html?m=1
And factor that into any complaint to either the landowner and the parking company.
You will not be appealing anything, you need to go at this as a complaint and a demand that the parking charge is droppedFrom the Plain Language Commission:

You aren't going to be paying. You didn't park. The discount is irrelevant to you.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Speaking from the point of view of a Cumbrian, never park at White Moss- it's notorious (as a Google search will tell you). It's part of the Lowther Estate so a complaint to them (Plan A) is worth a go (again, a Google search should bring up the details).

Hi,
Sorry if I'm barging in as a newbie.
I paid using a cash only machine for a parking slot and my return was delayed . According to cameras of the large private company managing the car park my stay was for 21 minutes longer than I had paid for meaning that I underpaid by £1.30p. I received a PCN for £100 which is now inflated with the usual additions as the reason for my delay was not accepted by the company. I made a SAR to the company which has now taken its claim to Court. Having sent in an Acknowledgement of Service to the Court I am now in the 28 day period from the Date of Service to prepare my defence which will largely be based on inadequate/misleading/overcomplicated signage that the company disputes. If the HM Courts money claim on line (mcol) service is used the defence is restricted to 122 lines of text. My questions are (1) Should I use the mcol text box and (2) What is the recommended online mechanism for sending the Court a more detailed Witness Statement and Defence please?0 -
@allshallbewell, welcome to the forum.
Please can you start a new thread about your predicament as experience has shown that trying to deal with the issues of more than one person in a single thread only leads to confusion.
In your new thread please tell us the Issue Date on your County Court Claim Form and when you filed an Acknowledgment of Service. Also tell us the name of the Claimant.2 -
Thank you and apologies for my error.0
