Car insuranc claim - guidance

Hi there, 

I was involved in an accident while reversing my vehicle from my driveway. I understand as per the highway code the responsibility lies with the person reversing, however, can some experts look at the attached images and see if the driver of the red car was driving on wrong side/middle of the road, while there were no cars parked on his side. 

The gap between the pavement and his car seem to increase. I know there are no lane markings on this street, so is there a case that I can put up? My insurance company has put me on fault for this, which I kind of agree, since I was reversing, however, the fact that other driver wasnt driving in his lane, does that hold up?

your suggestions would be welcomed!

    There aren't any defined 'lane markings' that I can see, so there's no 'his lane' to stay in - and you were reversing out into the road without observing oncoming traffic. As a layman here, I'd say purely you're fault, and the other car's position isn't relevant. You reversed into the path of an oncoming car without due care and attention. The only way I'd say you'd make it part-fault of the other driver would be if you could demonstrate he was speeding excessively, but again from the images provided - if that's the moment of impact, it's minimal, so yes, take the blame as you've outlined, and double-check your reversing manoeuvres next time.

    I checked all my blind spots before moving, but since I had 3-4 cars parked on my right, my view was pretty much blocked. I was slowly edging out, and suddenly heard lound bang.
