HELP: Parallel Parking Court Claim
Comments
-
1. I suggest that dressing smartly, doesn't need to be formal, just whatever you feel makes you look business-like, focusfes the mind and shows respect to the court.
2. Your defence and witness statement should already include that you are a litigant without experience and not a lawyer.
3. If you are the lay rep you are there to speak on behalf of the defendant, so the judge will expect you to do that unless they ask the defendant a dire t question. Make sure you tell the court clerk that you are appearing as lay rep and don't be put off if/when they say you cannot. Have a copy of the lay reps rights of audience order 19993 -

When you've gathered your thoughts, perhaps you can give us some details of the hearing - which court, Judge's name, who did the PPC field to represent them, what did they have to say, what did the Judge have to say, did you have to speak, on what basis did the Judge find in your favour? This information really does help us to understand the courts' and Judges' thinking which in due course helps other motorists who inevitably fall foul of litigation-rampant PPCs.Nice one. 👍Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Sorry I don't remember the name of the judge, but he was of East Asian origin I believe. The PPC had someone by the name of 'Ali' represent them. It was clear the judge and 'Ali' had numerous interactions prior to this hearing with regards to other cases. Without being disrespectful 'Ali' did seem like a novice in the world of representing PPC's in parking claims such as this. The judge went straight to the fact that the signage was not clear and excluded some important information/wording. I apologise but I cannot for the life of me remember what this was now. I wasn't asked to speak at any point. At one point, I did ask the judges permission to speak, but I was instantly shot down. I believe this was due to the judge knowing the PPC had no chance, so he did not want me to jeopardise this by me saying something stupid or out of line lol.1 -

ANOTHER ONE BITES THE DUST!
Now, get your real revenge:
Please do the Justice Committee Inquiry while this complete waste if time is fresh in your mind, if you want to change things:The Committee invites evidence on:• What the current level of delay in the County Court is
• The ways in which the County Court engages with litigants in person, and how this could be improved
• The causes of action giving rise to claims in the County Court
• What future reforms to the County Court should be considered.
Nothing will change if people don't seize this one-off Inquiry opportunity, and the good thing is, the Government is already actively finalising regulating the parking industry so change can happen in 2024 to the court process and the pre-action protocol, as part of the Framework already slotting into place.
The Justice Committee are not necessarily expecting submissions about parking cases though - parking cases would not have been on their radar when they opened this Inquiry, all they know is that there are horrific delays in the County courts - which is why we need to send them responses that tells them EXACTLY which industry is causing it.
The more evidence of parking claims wasting court time, the better. In your own words please."This inquiry is currently accepting evidenceThe committee wants to hear your views. We welcome submissions from anyone with answers to the questions in the call for evidence.
You have until Wednesday 17 January 2024 to make a submission to the committee."
