Great you made it onto the discontinuations list. Shameful you were only made aware of this on the day you attended court for the hearing. You may wish to support this
So many people don't receive 1st and/or 2nd pcn but the £170 payment due letter often manages to drop through letter boxes. PPCs always claim discounted/full rate pcns/court claim letters were sent as dated though they offer no evidence to prove this.
Since they CHOOSE NOT to provide evidence of their posting we must continue to press gov to ensure they do and see it included in the new Parking CoP. Please sign/share @jmccabe petition closes 22nd june 2024.

If you counterclaimed, did you pay the fee? If so, the claimant cannot discontinue, well they can but only their claim, they cannot discontinue your counterclaim! You need to get back on to the court and ask them for the N279 they should have received from the claimant. Also there should be a hearing for your counterclaim.2

Yes, there was a counter claim, i had filled out the form regarding a counter claim but as it wasn't worded correctly and i had not sent in my full reasons for the counter claim the court struck my counter claim very early on.
I think i put that my counter claim was for disability discrimination (but not how they had discriminated) and under the amount i put "whatever the going rate for Disability Discrimination is" so DCBL replied with something like, the counter claim shouldn't be allowed as we follow the guidlines to not discriminate and no actual amount has been stated.
In my statment i mentioned that disability descrimination would've been the basis of a counter claim due to their lack of enforcing Disable Bay Abusers.
I have considered reigniting the counterclaim and even claiming for the time i have wasted and the mental duress i have suffered when they knew from the start that their double charge was not allowed, wasting both the courts and my own time, claim the ink i used, the power used for PC and printer, an hourly rate of my time, fuel to and from the court, time taken on research etc. but my problem is, i am now a working man again, no help with fees anymore.
I did fill out the N244 form but it went nowhere.
If i knew a solicitor or if a group of people were willing to band together to fight UKPC and DCBL i would totally be up for proceeding with the counterclaim, have them bombarded with letters, have them face our fees and charges, itemised charges to so they can see exactly what they are paying for, but, alas, i do not see that happening, it bugs me to say it but i have to take solace in the fact that, although not told properly, i have won.1
