Can I get a refund?

    This is in their t’s&c’s

    ‘Our returns policy lasts 14 days, meaning you have 14 days from receiving your goods to contact us if you wish to return the items. If 14 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange unless goods are faulty.’

    I contacted them within 48 hours so we’ll within their 14 days plus my goods are faulty however they are refusing to allow a refund and instead I have to fix it.

    You have 30 days under the CRA to reject the goods for a refund if they are faulty - you do not have to accept a repair or replacement. After 30 days that changes. 

    You also have 14 days from delivery to cancel the contract for any reason and get your money back.

    I would simply point them to their own website which says:

    The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:

    a) Up to 30 days: if your goods are faulty, then you can get an immediate refund.

    That refers to your right to cancel if you change your mind and doesn't apply to this situation. :)

    @gazmad -  I'm not getting at you by saying this, but your first mistake was asking to send it back.

    You should have just told them that you were exercising your short-term right to reject for a full refund under s20 of the Consumer Rights Act 2015 (legislation.gov.uk) and asked them how they would be collecting it from you - unless the T&Cs say that you are responsible for organising the return of rejected goods - see s20(7)

    Is agree with you and it’s very much noted for the future.

    I have read their terms of sale and they state:

    9.3 When we will pay the costs of return. We will pay the costs of return:

    9.3.1 if the products are faulty or misdescribed

    Works for me.  They seem to sell all sorts, from slides and play equipment to a sit in toy electric car that is better equipped than my real sit in not-a-toy petrol car  :'( 

    It's got leather seats and a working MP3 player!  The toy car has, I mean.  Amazing, never had it so good etc.
