Stopped for 16 seconds at a zebra crossing - whilst I was stopped my partner jumped in the car. I paid £5 at the exit barrier. I've been charged £100 parking charge for being stopped on the gatwick red route. It says there is clear signage in and around the gatwick red route - I didn't notice. I was just trying to see where to go, signs overload!

Plan A is always a complaint to the landowner and your MP. The driver cannot be responsible nor have any control over what a random pedestrian does whilst the vehicle is stopped.

If no cancellation is forthcoming, appeal using the template in blue text from the sticky Announcement for NEWBIES. Send it unaltered from the keeper, save for additional comments that airport byelaws apply therefore the site is not relevant land so the keeper cannot be held liable, stopping is not a breach of byelaws, stopping is not parking, and the vehicle was stopped at a zebra crossing at the material time in compliance with byelaws.

Just ask them what they would want you to do if one of the airport employees was on the zebra crossing; should you stop or should you go go?

Dear NPC,

I am the registered keeper. NCP cannot hold a registered keeper liable. As a matter of fact and law, NCP will be well aware that they cannot use the PoFA provisions because Gatwick Airport is not 'relevant land'.

If the Gatwick Airport wanted to hold owners or keepers liable under Airport Byelaws, that would be within the landowner's gift and another matter entirely. However, not only is that not pleaded, it is also not legally possible because NCP is not the Airport owner and your 'parking charge' is not and never attempts to be a penalty. It is created for NCP's own profit (as opposed to a byelaws penalty that goes to the public purse) and NCP has relied on contract law allegations of breach against the driver only.

The registered keeper cannot be presumed or inferred to have been, nor pursued under some twisted interpretation of the law of agency. Your NTK can only hold the driver liable. NCP have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.
