Scammed on EBay advice

    I've never (thankfully) been in debt but if you hold off paying until she receives a summons, are you risking the debt increasing from what it is now?

    The debt will increase the moment eBay pass it to debt collectors as they start taking a cut for every letter, every visit made to the house. As I already mentioned though there has been no proof given anywhere on any forum that an eBay debt has yet gone to court. The debt collectors will harass and threaten legal action, but ultimately will drop it. EBay will then wait until the find an associated account they can take the money from.

    How does having a "old account" stop ebay clawing back the £250 ?
    Wouldnt the account go into the red and cause the seller issues down the road ?
  • I once had a debt owed to eBay for fees a long time ago, back before they took the fees automatically. It was a minimal amount that I didn't even realised I owed. They were very quick to send me a letter from a solicitor. Obviously, I simply paid the amount due, so no idea if they would have taken it further. Maybe not for the small amount that was due. 

    Also, regarding the zero feedback, people who use guest checkout show up with zero feedback.

    Oh that's a point actually , even if bank bounced the direct debit request they might still charge the fee for declining the DD.

    I have been thinking about this as I hate the scumbag scammers praying on the vulnerable and I wondered if there was anything at all that could be done to appeal to ebay for a goodwill gesture of some sort.

    I did consider the fact that having looked carefully at sales notifications and realised that they no longer carry a very prominent and highlighted warning about using the correct address. When payments came via paypal the warning was huge and I never understood why people missed it, but now it is hidden away under seller protection. THis is now the standard warning

    "Send your item with a tracked service within 2 days, the dispatch time you promised in your listing, so you’re protected in the event of a claim or dispute — and don't forget to update the tracking information. Most transactions are covered by seller protections, but this only applies if you use a tracked service."

    I would have suggested going back to ebay and appealing that it is not obvious that only the ebay address is covered, but then I noticed that the OP says 

    "few weeks later financial dispute raised from buyer wife didn’t respond in 5 day eBay limit."

    That's a real shame, I think there might have been some mileage in an appeal if the OP had made an attempt to prove delivery using tracking, Op did you not respond to the case at all, not even to acknowledge it?  If you didn't respond then I think the opportunity to do anything worthwhile with ebay has been lost, there's also a chance that if you had used the correct address and not uploaded the tracking, or responded to the case that you might still have lost it as ebay cases must never be ignored. Seller protection has rules and it pays to watch your account, especially with high end items like this.

  • I do think the address issue is a cop-out from eBay if it is obvious from eBay messages that they asked for it to be sent to a different address. It would be easy for eBay to check that. 

    But failing to respond to the issue is.. unfortunate.

    Old account no longer exists as she switched thereby closing it. 
    If the account was linked by a Direct Debit, then that transfers to the new account.
    It is also possible for card payments to still go through & banks can transfer these over.
