DCBL/PE “ WITHOUT PREJUDICE SAVE AS TO COSTS” after short defence submitted on MCOL

Prior to discovering this thread, I’d reached the stage of submitting the MCOL AoS and had already written a short defence on MCOL. It reads as attached.

I have since had the “WITHOUT PREJUDICE….” email from DCBL to settle, to which I have responded “I am not agreeable to this”

I’ve now got the WS template and the wealth of guidance here, but wondering (given the missed opportunity with the defence) whether hope of a discontinuation is lost?

    What did the manager at the Holiday Inn in Cambridge have to say when you asked him/her to cancel the ticket?

    Clearly you will need to provide evidence that a stay of thirty minutes was well within the time allowed.

    Anyway, all that aside, as you 'live outside the UK', why does a court case in the UK concern you?

    I am a UK citizen with a home in the UK - I am working outside of the UK presently.

    I have not approached the Holiday Inn as of yet, I will make contact with them now.

    I fear you are too late for that. That should've happened as soon as a Parking Charge Notice was received.
    It is unlikely that ParkingEye will discontinue the claim unless either someone pays or the court dismisses the claim.

    However, there may be a glimmer of hope...
    PE rarely outsource claims to DCBL. It seems that only when they feel they don't have a strong case do they do that.

    Wait and see what others say.

    I think you have every chance of discontinuation, if your WS is strong and especially if you can get an email from the Holiday Inn saying they want it cancelled and that the regime is not intended to penalise genuine patrons.  Or maybe the HI will cancel it.
