Another PIP question

Is there a limit on how many times you can apply for PIP? I ask because my son has a significant disability that impacts problematically on most of the areas of daily living and functioning that a PIP assessment covers. He already has one PIP claim waiting for Tribunal date. This claim was from about a year ago I think. However, since then his problems have got worse, as agreed by his doctors, and we put in a fresh PIP new claim, on the understanding, the other claim can still wait for the Tribunal to set a date. 

But on this new claim, we have been declined again, and also been declined at Mandatory Reconsideration. 

I'm wondering if they turned him down this time, because he has a Tribunal still to wait for? Or does that have nothing to do with it?

If we can get someone like the CAB to help, is it even worth contemplating making a 3rd PIP claim, or will that just make us look like a laughing stock and compromise the Tribunal decision (when we get to Tribunal as a result of the first claim, a year ago).

    To constantly reapply using the same evidence you previously used will likely see more refusals. Also reapplying when waiting for a Tribunal does complicate matters because the Tribunal will only look at the first decision and no other decisions.

    A worsening of condition doesn't automatically entitle you to more points. A GP will have very little understanding of the PIP descriptors so i personally wouldn't have taken their word for it and start another claim.

    For the Tribunal you're currently waiting for if your son is successfully awarded he will only be entitled to money owed up until the date the 2nd claim was made. Therefore you'll need to request the Tribunal for the 2nd decision.

    Agree with poppy.

    By putting in the second claim, you have ensured that any successful tribunal decision will only run for a short period, and any award will end at the date of the 2nd PIP refusal.

    I'm sure the last thing you son wants to do, is to have the stress and anxiety occasioned by appearing before numerous tribunal panels.

    As poppy says - your son really needs to get sensible advice on this:
    i) whether a PIP award is likely (what points do you think should be awarded and why?  I assume you have a copy of both PIP forms to show the adviser?),
    ii) to determine the best course of action given the 2nd PIP failure (if your son's condition has worsened, and if he should score more PIP points - then it may be best to withdraw from the upcoming tribunal and concentrating on challenging the 2nd decision),
    iii) At this point I would strongly advise against putting a 3rd PIP claim in.  Get some accredited advice instead.
