Renting with a CCJ

I have a CCJ which is falling off later this year (after 6 years) and we are selling our house and moving into rented. If for example the six years is up on June 1st will it drop off literally on this day or is there any chance before? We have 3/4 weeks before an agreed completion date and the CCJ dropping off so things could get tight finding a rental if it is literally 6 years to the day.

Comments

  • Yes, it's 6 years to the day.
Otherwise it would be well publicised that it drops off after 5yrs x weeks, x days.

In my experience, while it drops off after 6 years to the day, it can take a couple of weeks longer to update across all the various systems that lenders and reference companies use so if you have 2months left, I’d work on the assumption the ccj will be clear after 3 months.

However, I wouldn’t say that excludes you from being able to rent. The best thing you can do is be honest and upfront with any letting agency/landlord.

My wife and I were in a similar situation with a ccj each. We are in a rented house and were upfront with our current landlord about our ccjs. We are about to move in a couple of weeks and again were upfront with the new landlord and their letting agent and they appreciated the honesty and have given us the go ahead due to being honest.
