My son got attacked which resulted in him being in hospital with a severe broken and fractured ankle. Hes had to have it plated and pinned in several places. The surgeon has advised he won't be fit enough to fly at the end of May to go on holiday. His girlfriend has rang tu and they said to re arrange they have got to pay £1200. Even if they get a doctors letter it might not be considered. Can anyone help thanks inadvance. She booked it on line

  • Have they spoken to their travel insurance company? What have they said? They would normally cover anything like this

    agree this should be one for travel insurance
    If they read the TUI package holidays terms and conditions (assuming it is a TUI package holiday)
    to change date to later within 70 days of original travel date is treated as a cancellation
    to cancel 62-49 days before departure is a 50% charge (rising to 70% at 48 days)

    Let me see, could it be that there is no travel insurance in place?
    The common law of business balance prohibits paying a little and getting a lot. If you deal with the lowest bidder, it is well to add something for the risk you run, and if you do that you will have enough to pay for something better.

    You need to find out whether there is an insurance policy in place.

    It doesn't matter where it has been booked, they should have taken travel insurance as soon as they booked. Have they not done this? If not, then it will be an expensive lesson

    My thoughts as well, not mentioning it as a possibility in the OP usually means it is another ‘going to be bought nearer the time’ job. I have my fingers crossed though that I am mistaken and this turns into a simple insurance claim.

    It could well still be a package holiday under the package holiday regulations but one booked with the separate elements via a third-party i.e. loveholidays. Who are not noted for their helpfulness,
    As he has booked with them, he would have to go through them for any changes rather than directly to the supplier. And loveholidays terms and conditions will apply. So if that’s the fee their terms and conditions say, that’s what they will have to pay unless he has taken insurance to cover him.
