    So I have finally a hearing date and the claim company contacted me via email explaining they conducted a soft trace in 2021 with the address on the CCJ. I have proof from DVLA I wasn't in the address they send the CCJ.

    Now the issue is I am going to be abroad for family reasons so I need to change the hearing date. How can I apply for another hearing date?

    You can't without paying £108.
    So I have called the local court and they said for that to happen I need the other party to agree on changing the date and paying the fee.

    Or I have the option to as CPR 27.9 to go ahead with my absence which not sure is a good idea. I now have DVLA proof to add to the original email. So could potentially do this as far as I do request it by Wednesday the latest. 

    What do you advice?

    If you get the consent of the Claimant, I believe there is no fee.  But they are unlikely to agree (why should they?).

    Can't you just attend by phone? That's normal for courts now.

    Sorry for the late reply. After a few calls I managed to change the hearing date as I was only given 9 days before the hearing and the claimant also agreed to adjourn the hearing. 

    I will keep you informed.

    So the good news is that I am having the CCJ removed, but now I am waiting from BW legal to get back to me to discuss the parking fine otherwise if I want to defend myself I will need to go to another hearing for my defence.
    I am confused, as I thought that would be already discussed in the hearing.
