UKPC (DCB Legal) CC Claim - Allocated to Court - Discontinued today!
Comments
-
Hi all,
After following all the necessary steps post N180 (took months to arrive), the case was allocated to the County Court with a hearing date set for mid-January. During that time, DCB Legal contacted me on 3 occasions to attempt to settle outside of court. After standing my ground and refusing to settle for any amount of money, what I picked up on was on a few occasions they stated "So you're not willing to discuss this outside of court?" I feel like this is a loaded question and I made it clear I was more than happy to discuss matters with them but that I would not be willing to pay the amount they were demanding.
The poker facing game continued.
Trial fee was due today by 4pm.
As per the usual sequence of events, an N279 was received by email today.
@Umkomaas - another one for your stats!
Thank you all for your help; keep up the good fight you stalwart parking vigilantes!

Yay! Congrats.

ANOTHER ONE BITES THE DUST!
And we know it's a busy week but can we count on you joining us in this vital Inquiry?
Please please please also find time to do this relevant 'court work call for evidence' this week before it closes:
https://forums.moneysavingexpert.com/discussion/comment/80375249/#Comment_80375249The Committee invites evidence on:
• What the current level of delay in the County Court is
• The ways in which the County Court engages with litigants in person, and how this could be improved
• The causes of action giving rise to claims in the County Court
• What future reforms to the County Court should be considered.
Please tell them that private parking firms and their bulk litigators are the problem as far as small claims delays are concerned, as they dominate court lists.
Parking claim numbers are rising every year and will make up about a third of all small claims in 2023, based on the 2022 figures that the MoJ divulged in the DLUHC's recent Parking Code of Practice draft Impact Assessment.
Close to half a million parking claims are now made (2023 likely figure).
Astonishing that this has been allowed to happen and even worse, the CNBC thinks the answer is to EXPAND to accommodate it!
The MoJ must be required to separate parking cases by introducing a new pre-action protocol requiring use of ADR instead of inflated debt demands and bulk litigators who want court. It should be a last resort but it's the first. These MPs are inviting evidence not rants or opinion so we need people like you to respond, who are currently caught up in this nightmare that you are.
You want to change things?
This Committee is your voice.
As you know, the Government is already regulating the private parking industry, so they are listening and are aware of the scourge of unfair PCNs from rogues and bulk litigators.Interested parties have until 22 December to make a submission to the committee.
It's vital that this Committee hears loud & clear that the problem is parking claims and bulk litigators dominating the small claims track.

This is the method they use .... bullying and scare actics
But as always, bully boys are also cowards. We are watching this first hand1 -
Quick question, the 'trial fee' is the bit on the last page of the letter, where it says "unless the claimant does by X Date 2024 pay to the court..."
I'm asking because I can use that payment date as a milestone maybe, I'm getting close to this stage with my case.0 -
I suggest you start your own thread rather than asking a question on someone else’s that has bee concluded1

@AyeDubbleYoo, back in May it was suggested you start your own thread.
You acknowledged that post but still you haven't started your own thread.1 -
I don't see what the problem is with asking a question to someone who has the same experience. Weird.0

We can help you best if you start a thread. This is very much in your interests.AyeDubbleYoo said:I don't see what the problem is with asking a question to someone who has the same experience. Weird.
No case (dates, details) are exactly the same and this thread is to help the OP with their case.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you all for your help; keep up the good fight you stalwart parking vigilantes!Deadline extended until January:
https://committees.parliament.uk/work/7972/work-of-the-county-court/I've been posting a lot about it on threads to encourage victims to tell the Justice Committee that consumers need a bespoke 'parking pre-action protocol' designed to keep cases out of court.
Your case has ruined your peace of mind for ages, only for DCB Legal to walk away when you didn't blink.
This treatment of motorists should be illegal.
The 'debt claims pre-action protocol' is not fit for purpose for these cases. OBJECT to this and ask the Committee to insist on a proper ADR and 'private parking protocol' to resolve disputes and expose the worst scam PCNs out of court.
The reply form intrusively asks victims to tell some random thug/rogue ex-clampers all about their household and income/financial position, assumes there is a 'debt' owed under a credit agreement - which there isn't - and the debt claims procedure doesn't match the DLUHC's incoming Code of Practice. This inquiry is currently accepting evidenceThe committee wants to hear your views. We welcome submissions from anyone with answers to the questions in the call for evidence.
You can submit evidence until Wednesday 17 January 2024.
