I was going on holiday so i ordered a bag from Sports Direct on a Saturday and got next day delivery from Evri. I received a text and email the next day from Evri saying Natasha would be delivering between 10.30am and 2.30pm. My bag turned up 3 days later on the Wednesday !. I picked up an email at 4.30pm on Sunday from Evri saying there was a problem with my delivery. Because of this I had no time to make it to the shops to buy a small bag as I was flying 7am monday so I had to pay the extra baggage charge on Ryan Air which came to £63. The bag was delivered on the Wednesday while I was in Spain. To this day 28/3/23 I have exchanged nearly a 100 emails between myself Evri and Sports Direct. Evri admitted there delivery was 'non compliant' and Sports Direct apologised and offered £12 voucher. I at first refused as I wanted my out of pocket expenses from Evri, but thought, why not, £12 voucher ! but thought I would still be able to chase Evri for my £63. Now, after reading the MSE advice ive seen that my contract was with Sports Direct, that I should take it up with them not Evri. I have excepted the £12 voucher from Sports Direct so am I still able to try and claim my £63 out of pocket expenses from Sports Direct ?????

You can try whatever you like, but IMHO you have no chance of recovering that £63 from Sports Direct!3

You've probably done quite well to get an offer of £12.
I believe all SD are obliged to recompense you for is whatever extra you paid for next day delivery.
So if standad delivery is £5 but next day is £8, you would only be entitled to £3 if next day delivery failed.2 -
You are not entitled to consequential losses...No free lunch, and no free laptop

Of course you're still able to try, but I think they'll tell you to go away. There's no legal right to any compensation in this case.1

The delivery could have been delayed for any number of reasons - breakdown, sickness etc. Should never have left it so last minute.

Ordered on-line on a Sat and you were flying early Monday morning.
Maybe ask for a planner for compensation.

You are at liberty to pursue what you want to pursue, but there is no obligation for SD to pay your excess baggage fees. You've done well to get a voucher.2 -

Credit where it's due - I recently placed an online order with SD early on a Friday evening, not choosing any expedited delivery as I wasn't in any sort of rush, so perfectly happy to go along with their lead time of about a week. If that is true, and I doubt that it is, then I think EVRI and Sports Direct should sue you for wasting their time.
