Ok, I won't offer to pay.

My thought process was that the vehicle was parked in a car park and I do accept that a charge is justified for that 'service' - car parks do require upkeep and maintenance for which there is a cost involved or else we will just end up parking on rubble and soil. I was just trying to be fair about the situation in the hope it would paint me in a positive light should it end up in front of a Judge. Is £2 justified for a 90-minute stay? Probably. Is a £60 invoice proportionate? No chance. However, my reading of CM's posts has taught me that 'proportionality' isn't a great argument since Beavis.

This process really does seem strange, particularly for something that can end up in a courtroom. Negotiation, mediation and fairness are usually key aspects of such systems, but it appears such tactics don't work with these companies - despite them being staffed by I assume sentient human beings and not cold artificial intelligence.

Thankfully there are forum members such as yourself to act as guides through this minefield - no offer to pay the ticket price. Roger.

There is nothing "fair" about the way these ex-clamper thugs try and use a cloak of respectability to scam their victims by abusing the "system". Unfortunately, when the government set up the MCOL service, they didn't foresee its abuse by scammers.

These parking companies and their equally seedy lawyers who operate at the lowest end of the decency ladder may employ sentient humans, but that doesn't mean that they are not intellectually malnourished. It would probably be better if this industry could rely on something that involves "intelligence", artificial or otherwise.

Hopefully, their days are numbered with the soon-to-be-introduced government's Private Parking Code of Practice. You will no doubt see on this forum reminders to everyone to take part in the upcoming public consultation. Our own @Coupon-mad is on the steering committee and acts tirelessly to counter the PPCs who are trying to undermine its introduction. You can have a look at the CoP that will be introduced by early next year. It is only temporarily withdrawn because of a Judicial Review brought by the scammers and that is only for two of the items in the CoP.

Nothing happened! I didn't appeal to POPLA as I saw that was a bit of a kangaroo process and awaited the court claim aspect to progress - however it never came. I assumed it was down to them realising the machine didn't work that day and it being more trouble than it's worth. Over a year on and nothing has come through the letter box and I keep a check on my credit score and nothing noted on there (obviously).

Hopefully, this hasn't tempted fate and I come home tomorrow to a brown envelope... :D

Let's hope it is on the "too hard" pile BUT if you move house within the six years from date of event, make sure you update the claimant with your new address for service; you don't want a judgment by default because the sneaky devils have sent a claim form to an old address!

    Thanks @Le_Kirk,

I'll tell the missus we can't downsize for a little longer yet then - I'm in no rush to move into a bungalow anyway!  :D
