Small claims court in Ireland.Morfx said:Maybe I'm posting in the wrong section?
Basically these watches were recalled dude to an exploding battery issue.
If you agree to have your watch de-synced and you will dispose off it, Fitbit agree to pay you a certain amount.
I've agreed to that, they have de-sync'd the watch... Now not paying up... Where can I turn?

Perhaps they're suspicious that you've bought a load of watches second-hand to capitalise on the compensation they're offering per unit?Ultimately, it's off to small claims in Ireland if they're no longer responding.5

Small Claims in Ireland is limited to €2000. (Google) can't find how or where to apply for a larger amount.. any pointers muchly appreciated...powerful_Rogue said:

I'm not certain that you have a contract that can be enforced at all....These have all been verified and de-sync'd by Fitbit but they are now refusing to pay because the name on the accounts doesn't match the name on my PayPal account...
Even if you do, I suspect that somewhere in the T&Cs governing this offer it will say that the name on the accounts must match that on the PayPal account.
Have you asked FitBit why the name on the account must match that on the PayPal account? Can they direct you to the written T&Cs that confirm that?
Tell them you have simply done in good faith what they told you to do after you explained the problem to them. (ie as only a max of 5 could be registered to each account you were advised by them to set up additional accounts in respect of the remaining 13).
Have you any evidence of them telling you that?
It may be a simple case of miscommunication that you need to clarify with them
[Edit: Despite what they told you I wouldn't be surprised if there's a term limiting the offer to a max of 5 per individual (irrespective of how many accounts that individual has) or that an individual can only have one account.
Or they're just suspicious of 18 watches...]0 -
File two claims as you have 13 different watches? One claim for the max 2000 and a second for the balance?Morfx said:

I don't know if you can, but why not find out?0 -
With a different name on the Pay[al account it could look like it is fraudulent claim.
Someone, other than the account holder, is claiming a refund.1 -
OK. So FitBit told you to create additional accounts...Morfx said:
...Called customer services and was told to create different accounts to claim for the remaining 13...
... but did they mean you to create them in other people's names?Morfx said:
Names do not match as I had to create different accounts as advised by customer services via phone as I had already claimed 5 in my name at my address.MattMattMattUK said:
No, you cannot file against a parent company, you would need to file against Fitbit International Limited who are based in Ireland and it would fall under Irish law.Morfx said:Apparently Fitbit have no UK offices, but Fitbit is owned by Google. If I was to file a claim, can I file it Google's address???
Why do the names not match?Morfx said:These have all been verified and de-sync'd by Fitbit but they are now refusing to pay because the name on the accounts doesn't match the name on my PayPal account.
As Tadley mentions, you have Consumer Rights against whoever you bought them from, however as this recall was issued in March 2022 and is voluntary and in addition to your consumer rights I feel that they would be very difficult to enforce in this situation. If you bought from Fitbit direct then again they would fall under Irish law.
Your best option is to get the issue with account name and Paypal (or bank account) resolved.
5 trying to claim at my mum's address and her name.
5 trying to claim at a friend's address and his name.
3 trying to claim at another friends address and his name.
But I put my PayPal details and my phone number on the claim.
I wouldn't of minded to be fair, if they could still be used, but now the have been de-synced kind of renders them useless.
Didn't you think that might look a bit odd if the PayPal account name didn't match?0 -
Tried to create another in my name but instantly flags up "maximum number of devices have been claimed on this account"Manxman_in_exile said:

Will persevere with Fitbit for a month or so and see where I end up . 🤷0 -
The claims in other names should have been refunded to accounts in their name.
They would then pass the refunds on to you.2
