DCB Legal / UKPC County Court Claim Received

Good Morning,
Received a county court claim from DCB Legal on behalf of UKPC on 23 March 2023. It relates to two parking charges received last year. I used the services of Tony Taylor on a well known facebook group to appeal the charges at the POPLA stage but unfortunately these failed. Have posted up the particulars of claim below, will acknowledge the claim shortly and begin working on my defence. The registered keeper was not driving the vehicle at the time. Many thanks.

1. The Defendant(D) is indebted to the Claimant(C) for a Parking Charge(s) issued to vehicle REDACTED at Horizon Retail Park solarton Road,farnborough,gu14 7qj, Horizon Retail Park,solarton Road,farnborough,gu14 7qj. 2. The PCN details are 23/12/2021 REDACTED,24/12/2021,REDACTED. 3.The PCN(s) was issued on private land owned or managed by C. The vehicle was parked in breach of the Terms on Cs signs (the Contract), thus incurring the PCN(s).4. The driver agreed to pay within 28 days but did not. D is liable as the driver or keeper. Despite requests, the PCN(s) is outstanding. The Contract entitles C to damages. AND THE CLAIMANT CLAIMS 1. £340 being the total of the PCN(s) and damages. 2. Interest at a rate of 8% per annum pursuant to s.69 of the County Courts Act 1984 from the date hereof at a daily rate of £0.04 until judgment or sooner payment. 3. Costs and court fees

Who is Tony Taylor and what is his speciality? Was the PCN PoFA compliant? Did Tony Taylor advise about identifying the driver?

And the difference is also that he is an ex UKPC employee and we'd say no-one should even give his 'appeals' a second glance, let alone use his words and pay him money! My goodness. Tony Taylor, thought he'd stopped doing this years ago. By all accounts, he never could get his head around IPC cases nor court claims.
Get yourself off his Facebook group.
Anyway, just copy and adapt the recent defence posted by @Johny86 and just change paragraph 3.
Easy peasy. DCB Legal will discontinue.

Thanks for the replies, unfortunately they must have been PoFA compliant, driver has not been identified at any point. Unsure what to put in the defence as the driver was simply out last minute Christmas shopping, parked in what was/is a free car park and didn't realise that there was a time limit of 2 hours. The overstays were for 25 minutes and 34 minutes. I've flicked through the forum and the linked thread and hope that they will fold before the actual court date but unsure what to put in the defence as to why the driver overstayed. The driver has previously purchased a kitchen and a sofa from 2 shops that reside in the car park amounting to well over 10k, although this probably isn't relevant to this alleged parking misdemeanour. However, I can't see how overstaying in the car park has cost anybody any money as this car park is never filled to capacity and this was simply an oversight by the driver who was spending money within the town of Farnborough. They could possibly argue that the signage on entry to the car park is not adequate, I will get hold of an image of the signage asap.B789 said:Who is Tony Taylor and what is his speciality? Of course you argue signage. That's just one of the elements of your defence.
Forget about the cost of staying in the car park. It is not relevant. Did the driver know they were overstaying or did they only find out about the time limit after they received the PCN. If so, how come they didn't know about the time limit? Maybe because it was not obvious which means there is a problem with the signs. Are they prominent and obvious? Are the lit if it was dark? So on and so on.3 -
As said by B789, it is the signs that matter, especially the entrance sign. All UKPC signs are unreadable needing binos to read them and posibly a step ladder.
Send UKPC a SAR to see what signs they send you
Try and take your own pictures and post them on here
DCBL
They have added a fake amount to the £100 and say their client is entitled to damages. UKPC will not own the car parking site so they are not entitled to damages
This is a copy and paste roboclaim from DCBL signed by the usual Yasmin Mia. What Yasmin has signed is a statement of truth and the so called fake add-on and damages are not true. You are fully entitled to ask DCBL ABOUT THE FAKE ADD-ON and who would benefit from the damages claimed.
Never seen DCBL reply to this and a non reply would disturb a judge. So would the statement of truth which could well lead Yasmin Mia being in contempt of court .... that is serious
Forget about POPLA as they have become friends of the parking companies. A BPA FAILED INVENTION
As Coupon-mad has said, this will end up being discontinued as UKPC cases are rubbish and DCBL will not want a spanking in court where you can also claim your costs
Before they discontinue, they will try their best to make you pay before the actual court case ....... Do not be tempted

He's not "good" at what he does, IMHO. From cases we have seen (including yours) his advice can be hopeless and I for one am uncomfortable with that FB Group being linked here. No newbie should be going there.
