Habitual residence test

I have failed HRT and have no rights to any help , I left the uk with my mother in 2017 as a child , I am a uk citizen . I have returned to the UK with my child after issues with domestic violence etc. after requesting help I have been told to wait 3 months , as the return was “forced” I had no opportunity to save to support myself. Is there no help at all available , I have a place to reside temporarily and am relying on help from family . I am certainly not a benefit tourist but am being treated as stt if ch . Any advice

"In some situations, you might be able to claim benefits earlier. For example - if you return after being abroad and were habitually resident before travelling, the DWP will consider your ties to the UK and why you left. They might decide you’re habitually resident immediately."
Which benefit are you trying to claim - UC?

Left in 2017 - with your Mum, returned 2023 with a child, due to domestic violence.
Where is Mum now, could you not have stayed where you were?
Youve kept your British citizenship (and i assume passport) so have the right to return and settle.
I get you've no savings but were you working abroad.
Reading between the lines you should be able to claim UC and at some point CB, JSA is dependant on NI payments (which I believe you wont have paid) But as you say you've been told to wait 3 months. Id look at getting a NI number (if you haven’t already got one) so that you can potentially look for employment.
