New home Developers and Land Registry

Hi, we bought a new home 2 years ago,  which we have  now put up for sale. We found out that it is not yet registered with land registry. After waiting nearly 3 months and because it is not registered our buyers have pulled out. We appealed to the conveyancing solicitor who ,after inquiries to Land Registry, told us there were concerns about plans from the developer. Our conveyancing solicitor, who has tried to absolve himself of any blame, has said that there is land , i.e. a set of communal stairs, which were not included in the original plans which the developer would now be producing for land registry. We are furious about this and are wondering where we stand as regarding acceptance of this

    While your solicitor could ask Land Registry to bump the  review of your application for registration up their to-do list, this wouldn't speed up then dealing with any queries they raise. It sounds like that is what is taking the time unfortunately.  Have you asked your solicitor to explain exactly what the issue with the plans is and what is being done to sort it out?

  • Yes the solicitor has requested it to be expediated and that's how we have discovered the plans, from the developer, were incorrect. The solicitor has said that they are being changed to include an area ,communal stairs, which we will have to be responsible for. We are unclear as to where blame , if any, is to be apportioned, is it the conveyancing solicitor or developer and do we have to be responsible for the change of plans?

    Impossible to know without a lot more information. What plan are they saying needs to be changed and why does this mean you becoming responsible for a communal area? That sounds very odd.

    Your solicitor is the correct person to ask for information on the ramifications of this - as they have access to all the information provided both when you purchased and since.  There is a bigger issue here than just the registration.
