    I've received a letter from the solicitors which was obviously sent via post on the same day as I received their message about not taking my problems into consideration. It states:

    We have been notified of a personal circumstance that you wish for us to take into consideration when managing your account.

    In order that we comply with your rights under the Data Protection Act 2018 we require your written or verbal consent to update our records and store this information on your file.



    Surely they don't need me to keep my info on file if they're saying it doesn't affect the case? Do I need to sign and return the letter anyway, in case it does go to court?

    Do you understand your rights under the GDPR?  Unless you do and you believe the solicitors are incorrectly interpreting them in seeking your consent, then I'm not clear what any objection is. Can you explain?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I'm just unsure what changes in circumstances they need to keep on file as they've discounted what I've told them.

    It's to do with how they have to treat 'vulnerable' people.  There are specific debt chasing rules about that and they are trying to hide under a veil of reasonableness.

    Say yes that they can retain the information but you expect them to share it with their client and cancel the meritless PCN.  Secondly, you do not have an 'account' with notorious bullyboy bulk roboclaimers of their ilk.  So cease and desist with paying lip service to the DPA 2018 and the rules about treatment of vulnerability.  It is obvious what BW Legal are doing and you are not intimidated or fooled, so they may as well consult with their client and jog on now.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
