As a matter of interest, in a case like this, if it is set-aside without consent, is it likely or even possible that the judge would order that the set-aside costs are reserved or is the defendant liable to those on receipt of the set-aside judgment?
Definitely not it would be for the defendant to bear
  • Hello, OP here. I'm going to complete the form and send it off to the court today.

One question - can they charge interest on the CCJ?
  • @Coupon-mad thank you so much for your help thus far.

I'm really sorry - but I'm reading through the Newbies post about what to include with the N244 - but it's about as clear as mud!

There are multiple links to multiple page threads with loads of comments from different people sometimes offering conflicting advice. For someone with ADHD it is a real nightmare to work out what is the important information amongst all of this.

Can someone please help me with concise information about how to do this?

    Many thanks

  • Hi Guys

I'm sending off my N244 along with my bank statement (proof of address - they sent to wrong house!) and plane tickets (as I was abroad at the time claim form was sent out) tomorrow via post to the CCBC in Northampton.

Unfortunately I cannot work out how to pay the set aside fee. It is not clear in this letter!

What else should I do next?

    Thank you
  • PS can anyone confirm if they will keep charging interest on the fee owed? I am very anxious about this.

Yes, interest can accrue but you getting the CCJ set aside reverses it anyway.

Most people email the N244.  Don't post things to a massive admin centre for them to lose.

You are appending a Witness Statement as well as those exhibits?  A WS like those seen in the threads by

  • This is what I'm going to send as my witness statement.

"I am writing this witness statement to support my request to set aside the CCJ placed against me on 13th of February 2023.

From the 14th of January - 1st of March I was abroad, in XXXX, and did not receive the letters sent to me at YYYYYYYY.

On the 12th of January they sent a Claim Form. On 13th of February the CCJ was sent. On the 16th another letter was sent from Gladstones Solicitors. I was not aware of any of these letters until the 19th of March when I visited my parents house.

Additionally, my address is ZZZZZZZ. I am registered on the electoral role and this is accessible information.

I will attach copies of my plane tickets to and from XXXXX as evidence to the fact that I was abroad at the time the Claim Form.

I would also like to point out that I have ADHD, and have trouble understanding reading large chunks of text such as these letters, which are very confusing and not very clear whether it is actually a county court letter or a fake claim from solicitors.

  • I can't find an email address to send this off to and have looked everywhere on google for it! I'm going round in circles!

    You need more than that.

Please click on the profiles of the 3 I linked for you and spend a day reading the WS they wrote.
