This isn't deprivation because the person who leaves their share to someone other than their spouse isn't depriving themselves of anything - while they are alive, they still own the asset; after they die, they won't have a call on council funding for a care home.lisyloo said:I don't think you can deliberately deprive yourself of assets to avoid care fees.
You can certainly do this to avoid inheritance tax on second death though and it's a common thing to do.
