    I'll respond to this properly when I get back to the office but effectively see will be deemed intentionally homeless if she leaves before the date of the eviction.

    As only she or a court can end a tenancy this is in line with legislation.

    She may, however, also be deemed to be intentionally homeless as a result of the rent arrears.  This is the choice of the individual council, especially as she has had benefits to cover the rent.

    Sorry, I did get back to the office yesterday, had to call a client and that didn't finish until about 10pm.

    Just to add, the family court shouldn't be anything to do with you, this would be from the County Court.

    Any questions I'm happy to answer.

    That would make sense to her thinking then, it's the CC part it'll go through.

    It may be worth (just for her information and completely diplomatically of course) forwarding her to this page. It includes a checklist of documents she will need.

    Are there any aspects of legislation you need help with? Or practical advice for the 'on the day' stuff?

    As many older posters will know here, my background is dealing with this from the tenants side as a volunteer, however if you have any specific questions you'd like to be answered I'm happy to do so. I'm no longer politically active but do maintain business interests in this area (not as a LL though, as a service provider to some estate/lettings agencies) and my concern has always been that due legal process is followed by both parties, so please don't feel I'm working against you if I seem pro-tenant in my postings, which I appreciate may appear to be the case.

    She is in contact with the council.

  • Update gotten bailiffs date for the 26/07 hopefully council helps tenant before then.

    Bailiffs coming tomorrow.

    Tenant has stopped communicating, last message was 06/07.

    I do not know if she will pay the rent for July.
    Has some arrears from previous months around £500 and has not paid the court fees ordered her to pay.

    I am glad she is leaving and starting afresh.

    Tenant has finally left. 
    Bailiffs and locksmith were here before 11am.
    Was owing Total of £2370 which consisted of the 26 days, previous arrears and court fees ordered £355.

    Communicated with her and her sons to at least pay the 26 days rent and will let the other payments go. 

    I am glad she has now paid £1500.

    Not sure would have been successful going through court to get anything from her.
