Replacement of faulty goods with new ir refurbished?

Bought new MS Surface pro8 4 months ago which is now faulty. Been told MS will repair or replace, however theybwill only replace with a refurbished item and notva new item.  I can't find on any web page if this is legal?...can I demand a new machine or fo I have to accept a refurbished mschine if it can't be repaired?

    Yup, totally legal. You don't have a new device, you have a 4 month old device.
    You can demand, but legally they don't have to give you a new device.
    Did you purchase direct from Microsoft?

  • No through Currys, but they have no replacement Surface pro8.

    So basically I could receive a 1 or 2 year old machine, with a hard disk that could be ready to die at any point or a battery that doesn't charge to 100% or hold its charge for the recommended time for a new/4 month machine?

    Not necessarily. What you're describing sounds like a manufacturer warranty solution. You could pursue Curry's via consumer rights, but even then you'd only be entitled to a repair, a replacement (which could be used) or a refund, which could be reduced to reflect use to date.

    I imagine that a Microsoft refurbished product is effectively remanufactured and will either have a good battery or a new battery.
    In addition SSD will more than likely last for years
    Microsoft will run extensive tests on it before it is sent out.
