hi guys
my girlfriend has received a final reminder from UKPC for an overstay on a retail park car park. this is the first letter she has received and they are asking for £100.
she does not dispute that she mistakenly overstayed by 22minutes. but looking at the letter she has missed the 40% as she did not recieve the original fine.
is there any way of at least getting this reduced back to £60.
i have drafted the below letter but not sure if this is suitable.

Dear sir/madam (UKPC)
I refer to your final reminder dated 03/03/2023 with the reference number ************** requesting the sum of £100.
You refer to a previous notice that I DID NOT receive.
section 20.7 of the british parking association code of practice states that if payment is made within 14 days of the notice then a 40% reduction should be applied.
As the first instance of this was only brought to my attention with your letter dated 03/03/2023, I believe I have been disadvantaged and your request of £100 is disproportionate.
Please could you review this invoice.

Where on that Burnley Retail Park sign does it warn drivers they are entering a private car park or a prominent sign that there is any time limit? The smaller UKPC signs are unreadable and in my view could not be used to form the contract that has allegedly been broken.
It does seem that some PPC NTKs regularly go astray. This works to the benefit of the PPC so they can then start their scam at £100. It also results in their victims ringing up to complain and blabbing about who was actually driving. Perhaps your GF should submit a SAR now to see if the NTK was POFA compliant.2 -
@walshy.walsh After you've tried Orbit to get the PCN cancelled, there's nothing else to do, unless you want to let your girlfriend pay these scammers. Do you really want to pay £60/£100/£160 when you don't have to spend a penny?
Just read the Newbies thread and see what happens next and when your girlfriend has to do something. Why was she even looking for the discounted fee? If or more likely when this gets to LBCCC or LoC stage, the Newbies thread tells you how to respond and by when. Eventually, the UKPS scammers and their legal reps, DCB Legal will issue a claim and once robustly defended as 99% of all other UKPC/DCB Legal cases, they will discontinue.1 -
just an update guys, all it took was one phone call to orbit and the ticket was cancelled straight away without the slightest arguement3
