courtesy car after no fault accident

Hi, I’m trying to get some advice for my son, he was involved in an accident caused by another driver 2 weeks ago, this was admitted by the other driver to his insurance company, the claim was initially delayed as the other driver was hospitalised, his insurers are now saying they will not pay for a courtesy car for my son as h3 has previously been banned from driving altho obviously that ban is now spent, what is his situ re compensation for having no car ( his car was written off) for this period of time ? , could he insist on the value the insurance company would have paid if they had hired a car ? Any help or advice gratefully received

    Approach the third party insurers, they will most likely be happy to provide one but their hire car company may have issues with driving history too.

    Alternative to having an insurer provide a car is either to 1) hire one yourself and claim from the third party insurer or 2) claim loss of use from the third party insurer. In my claims days it was £10/day whilst without a vehicle but imagine £15/day or such is more appropriate now.

    Can be better to go through the 3rd parties insurer. They will not want your son to have large costs so they would try to source a car themselves.
    If he can reasonably get the bus or trains or even taxis for less then he should do that (and keep receipts).
    Yes he entitled to reasonable amount for replacement car hire.

    Does he have legal cover with his insurance?
    If he does he can use this to claim it back.
    If he doesn't then he'd have to claim it back himself and wait.

    If the insurer have done nothing then personally I would withdraw the claim and ask the 3rd parties insurance company to deal with it. Often they are falling over themselves to be helpful as they want to control the costs themselves.

    When you say his car was written off do you mean that it has been formally written off and he has been paid it's value? Or just that it's obviously badly damaged and you expect to to be written off?

    If it's the former then it's a bit late to be worrying about a courtesy car - if he needs a car now he can go out and buy one with the write-off money. Possibly he would be entitled to a payment from the third party insurer for loss of use while it was being assessed.

    If you mean the latter then he should approach the third party's insurers - his right to a replacement vehicle from them won't be affected by the fact that he has previously been banned.
