Thank you, yes I know - he produced the letter (of which I'd received a copy) stating that as well as the fine - now at £240 I'd also be liable for his fees of £220 should I be unsuccessful, but, because of this site and all of your advice, I knew that he was just trying to intimidate me.
And do you know... at that point, I didn't really care. Ever since the very first letter arrived, my feelings were that of irritation/anger that I was being scammed, and I wanted to put my side in front of someone in authority (like a judge). I always knew I might lose - simply because payment was not made, and I was prepared to lose with the hope that in future, should a similar case come before him, the judge might just remember my case and realise that Excel Parking were taking advantage of this complicated third party software and generating a lot of revenue from unsuspecting motorists.
I told the solicitor that I would accept whatever decision the judge made, but obviously I'm so happy that it went my way. It's been an experience but I'm very relieved it's all over. I just wish I could have been a 'fly on the wall, when he reported back to Excel... I like to imagine he said something like 'The lady was not for turning' Lol!
Thanks again for your advice and encouragement, hopefully many more motorists will dispute these unfair charges, and these rip off companies will waste even more money losing in court.2 -
You're a woman after my own heart! Determined to beat scams.
Well done, it is empowering when you win in court and reassuring when you get a decent Judge.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
