    The back of your County Court Claim Form tells you:

    Note the last sentence there - "The day of service is taken as 5 days after the issue date shown overleaf".

    It goes on to say:


    This is confirmed in the Money Claim Online (MCOL) - User Guide, which also explains that a Defence is never due on a non-working day.


    On page 14 of that document it says:
    How long does the defendant have to respond to my claim?

    The court will send out a claim pack to each defendant once the claim has been issued and allows 5 calendar days from the date of issue for the service of the claim. Therefore the 'date of service' is the 5th calendar day after issue.

    The defendant has 14 calendar days from the 'date of service' to file a response. If the last day for filing the response falls on a day that the court is not open (i.e. a weekend or public holiday), the court will allow the next full working day for a response. The defendant can extend the time to respond to 28 calendar days by filing an acknowledgment of service (AOS).

    Only post the paragraphs that you have changed,  not the rest ( its your homework that is being checked. )

    It is rare for anyone to change the other paragraphs, without extremely good reasons for doing so 

    Never post the full defence on here, nobody will read it, but you do include all the paragraphs in your final draft and save it as a PDF document, ready for attachment to your email to the CNBC

    Is this the same case? You should keep to one thread for one issue; it isn't necessary to start a new thread every time you have question.  Just email the forum team and ask them to merge the threads if they do relate to same case.

  • Thanks everybody for your support. I wanted to check how can I update my address in MCol, the option is not available there as it now uses govt gateway. Also how can I tell court and defendant to send me rest of the case documents on my new address? 
    Note: Both sent me documents on new address but my acknowledgment through MCOL still shows previous address so I think they might consider MCOL address as my current address, acknowledgment having old address.

    Email the CNBC to update your address, giving them the future address for the service of papers, as per GDPR

    See Case progression in the template defence thread by coupon mad 


    Email the DPO at the Claimant parking company and cc their lawyers too. ( Known as a Data Rectification Notice. )
