Copy of leash or managment resale pack

Hi guys, 

I already have my mortgage offer ready.

My solicitor told me the seller's solicitor, in the initial query, has not provided a copy of the leasehold or the management resale pack. 

Do you know how many weeks it takes for the document to come through?

    We had management agents that were pretty good our entire occupancy, and they still took something like 12 weeks to provide the management pack. 

    Our solicitor had commented upfront that getting of it was likely to be the longest part of the conveyancing…

    I thought you could download a copy of the lease from the Land registry - maybe I am wrong

    You can order it online, I think. But I'm not sure that's what the OP's solicitor is missing - it sounds like it's the management pack they're waiting for.
  • I just download the document for 3 quid. It shows the owner's name and leash remaining, fyi, it has 129 years remaining. 

    just get the confirmation from the seller that they did not miss any ground rent or service charge money - I would not be responsible for it. the service charge company ought to chase the seller once they sold to me. 

    Why do I have to care if they owe money, they lived there not me.

    No, in fact, when I viewed another property, SA told me the seller owns the managing company some service charge money which I would be responsible to pay if end up buying the flat

    I'm just saying it is really not fair. 

    Imagine the report comes through after 2 or 3 months and we found that the seller owes money - broken system!

    If the seller owes money (i.e. they haven't paid their service charge), it will be paid on completion.by the buyers solicitor.

    That's one reason why the solicitors asks for a management pack - so they can see if any money is owed, so that it can be paid.

    The 'system' is designed to work that way.

    The situation is a bit more complicated than that.

    • The freeholder would not 'register' you as the new owner of the flat, if there was any ground rent or service charge arrears.
    • If the previous owner received a ground rent or service charge bill but hadn't paid it - you're correct that the company should chase the previous owner for it. But if it remains unpaid, the flat can be repossessed - so you lose your flat.
    • If there is ground rent or service charge outstanding, but no bill has been sent yet - you would become responsible for paying the outstanding ground rent and service charge when the bill is eventually sent.

    Solicitors have a 'system' for dealing with those things - so it's generally possible to get a fair result.
