IVA & owning a car

Hi,

I’ve had an IVA since September 2019, I’m now in a position of getting a car, my dads paying for it for me (£750) I was wondering how to insure it as it is a form of credit, so I rang the insolvency company who basically said I need to provide them with proof that my dad has bought the car for me, which I understand, but I also need to provide them with the cars insurance number (?) and they will review it and decide whether I’m allowed to insure it or not.

I’m a bit confused, is this normal practice? Can they really dictate whether or not I can drive or even own a vehicle?

    Best advise was not to tell them, get your dad to buy and insure it in his name, and put you as a named driver.

    Take the cost out of your budget for food or whatever.

    I would do that anyway and just not respond back to the IVA company, they will soon forget you asked, as with most IVA companies, their attention span will be very short.

    Best advise was not to tell them, get your dad to buy and insure it in his name, and put you as a named driver.


    Which would be insurance fraud through fronting. Really shouldn't be suggesting people commit fraud.

    How much is the insurance? Thought the rules were something like credit above £500 could only be taken if the company knew you were in an IVA?

    From recent memory of insuring a car with named drivers one of the questions asked who the main driver would be. Could her dad insure it with her as the main driver?

    I can't see that owning a £750 car in itself is going to be a problem. Or even being the registered keeper of a car you do not own.

    But can you afford to run it (Fuel, insurance, mot, tax and maintenance) and still have the same surplus income to pay to your IVA?
  • Thanks for the replies, I’m going to talk it through with my dad and see what can be done, obviously I don’t want to be doing anything I shouldn’t be doing.
    The insurance is around £65 a month, I have read something similar about the £500 credit only.
    The question from the IVA company was how have I got the funds to buy a car, which is fair but I won’t be paying for it.
    My circumstances have changed since starting the IVA so running it shouldn’t be an issue, they’ve just thrown an obstacle in the way of doing so. They know all of this and I’ve never missed a payment.

    Explain to me exactly why that would be fraud ?

    Many people do this, makes no difference in law who owns or insures a vehicle as long as whoever uses it is the insured party.
