Crown Wharf, Wallsall

Hi All,

Just been reading through the threads and hope someone can please guide me to the sticky I need to challenge a Parking charge from group Nexus for parking at the Crown Wharf in Walsall.

The charge is for not buying a ticket. I did and have a bank statement to show a £1 debit going out to CP Plus LTD. I was about to send it off as part of my appeal and but I have seen some threads where I can challenge by saying I was not the driver?

Can someone point me in the right direction regarding how I should appeal or confirm that I was not the driver?

Thank You.

Depends if the PCN has the required keeper liability wording, which some CP Plus ones do now.  Most do not.

I have attached a copy of the parking charge. Does this have the 'required keeper liability' wording you mentioned?

If it doesn't. I've taken a look at the sticky on the text to use on the appeal. Would I need to add my details into the first/last name on the appeal page or should I just put other/ registered/ keepers in the fields?

    Thanks

The person who is named on that Parking Charge Notice must reply and of course they must give their full name and address when making that appeal.

You can see it doesn't; I link the POFA in the NEWBIES thread and you can see the words are those set out in plain English in 9(2)f of Schedule 4.

Also check the reverse of the PCN.  The 9(2)f warning (that the keeper will be liable after xx days) is either there or it isn't.

It is easy to check it yourself and you'll understand it better if you do it, not us.

Of course the keeper's details must be given in the appeal.  CP Plus already have them...

This is a prime example of someone who is requesting assistance but hasn't read or at least re-read and digested the contents of the Newbies thread. It's no use just skimming through that thread because there is so much information in there.

Help yourself so that you may get help from others on here. You need to understand what POFA 2012 is/means. You can then understand why @Coupon-mad is telling you to also read the back of the PCN to establish whether the PCN is POFA compliant. The Newbies thread tells you why this is important and explains why you should not be identifying who the driver was.
Good grammar adds tone and nuance to the "written" word which is normally perceived in the "spoken" word. Without good grammar, you can be perceived to be an idiot or a fool without ever uttering a sound.
