Assist Legal and Kudos Legal Limited - Help have I just been scammed???

  • LV are providing a legit hire car for me. Thankfully. I am concerned that one of these companies will try and still go through with this - I have had email confirmation from AX to say that they are closing my "claim" and I will not incur costs but not Legal Assist/United legal/Kudos who all seem to be the same company who have "Discomfort claim:" with me.
  • Have you spoken to your insurance company? 

    They should be dealing with the other parties insurance company.

    What advice have they given you? And what do the documents you have received from this company say.
    I did in the end. The language AX used made me belive i didn't need to which I can't believe I was so gullible for. I have had emails on letter heading stating that my claims for both Ax and United Legal Assust are cancelled and Kudos legal stated my file was never created  as it had only just been instructed. I asked them
    for an email stating that which I am yet to receive.

    I'm worried these companies will sell my details on, I've logged an action fraud account and called my bank. Thankfully I judged my credit card to secure the hire car but there was no charge. I did send them drivers license details though. Is there anything else I can do to protect myself from identity theft? I've changed every password I can think of and set up two step authentication on all my apps. 

    I just feel so stupid! :-(

    Read the contract fully... a dark room and cold towel may be necessary for later because the wording tends to be fairly complex to deal with previous high profile cases that accident management companies in general lost. Most will say your liability is capped to the liability of the third party as long as you continue to support them in their recovery efforts. IE no short fall will be passed to you and the third part insurers naturally pay the third party's liability

    Secondly, they will absolutely have offered a like for like vehicle replacement as it maximizes their rental charge but be honest about if you really need the same type of vehicle or could you get away with something smaller/less powerful etc whilst the repairs are being dealt with therefore showing you are mitigating your losses.

    You've been more savvy than most... many have their BMW X3 hire car for 2 months thinking its courtesy car from their insurers and only afterwards realise they've run up a £21,000 bill and start getting asked to provide evidence that they needed such a car, that they couldnt afford to hire a car themselves etc. Obviously by this point its too late as its support them or pay the £21k themselves.

    I have to admit I dont know if BISL do claims handling on behalf of the insurers or if the insurer does it themselves. If you are still in friendly dialogue with the TP you could ask them who the underwriter is named on their policy schedule and if they have been passed to them to deal with their claim or if its "M&S" dealing with their own damage 
    I rang the other driver and we had several conversations as she said BISL had laser her straight to Churchfields or something similar who I presume are the underwriters. She had not been contacted by AX but said BISL/M&S are handling this pretty badly so far. 

    I think I have got out of the three companies who signed me up and I have written proof from two but I am now worried about indenity theft as prev stated.

    My insurer have offered me a hire car but only when mine goes away to be assessed with inhave konide when it will be. I've inspected it further today and it seems to be purely cosmetic damage to the plastic bumper and I'm seriously
    consideribg not claiming.

    Churchfields isnt an insurer I've heard of, it could be a claims outsourcer as I only know the larger ones of those as there are so many small ones but more likely its a bodyshop and Budget have some delegated claims authority for at least first party losses

    She is the at fault party so wouldnt be contacted by AX

    I've always found the difference between M&S Home/ Travel (Aviva - insurer) and M&S Car (BISL - Broker) a little perplexing... having gone mid market (upper mid for their Premier) on two products and Budget/budget on the third.
