Hi there,
Was hoping someone could help with a SDLT query. Last year I paid the 3% surcharge as I purchased an additional property that became my 'main residence' - Home 'B'.
The original property, Home 'A', was turned into a rental property.
I am aware that as per SDLT conditions, I can get a refund on the SDLT surcharge if I were to sell Home 'A'. However, does the case still apply with Home 'B'?
We are looking to sell our main residence and emigrate, but keep the rental property (Home 'A').

Unfortunately, selling Home B would not entitle you to a refund of the extra 3% SDLT paid on the purchase of Home B. The legislation tightly defines when a refund is due and this scenario falls outside of that.Gg1295 said:Hi there,

as said above, only selling home A will give you a refund.1
