I am in the same situation, I drove myself to LHR whilst boyfriend slept. Got out, gave him a fiver and told him to pay for the dropoff assuming they'd be barriers, there wasn't he forgot and then I get a letter stated I owe 80 pounds for failing to pay. I have read and re read the newbies thread but I feel as though there are parts of that blue template like the one that don't apply to me and dont want to mess it up  cold_sweat

is it really just this?

 I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

    I will repeat here what is advised in the other thread where you originally posted:

    Whatever you do, do not identify the driver, directly or by implication as you have above where you say "I drove myself to LHR". Always refer to "the driver drove to LHR" or "the driver did this" or "the driver did that".

    Why you may ask?... If you have read, re-read, digested and begun to comprehend everything that is in the Newbies thread near the top of this forum you would, by now, know that airport land is not "relevant" land because it is covered by airport bylaws. What that means is that their PCN is not POFA compliant and liability for the charge cannot be transferred to the registered keeper of the vehicle. As APCOA do not know who the driver was, they have nowhere else to go with this.

    What APCOA rely on is victims of this process to poop their pants at the first PCN and blab who the driver was. In that case, they now have a driver to pursue. You haven't blabbed who the driver was, even inadvertently, have you?

    So, your appeal to APCOA could be as simple as:

    Dear APCOA

    Ref PCN:XXXXXX

    You have requested that I, the registered keeper of the vehicle, provide you with the drivers details. As you are well aware, POFA does not apply as the charge is for an event on non-relevant land which is covered by airport bylaws and liability cannot transfer from the driver to myself, the registered keeper. I am under no legal obligation to provide you with the drivers details and no assumptions can be made.

    So, I request that you cancel this PCN and save yourselves the POPLA fee where this would be cancelled.

  • I don't think I did as that option wasn't shown, just sent what b789 suggested.
    Would it be a similar thing for Euro Parking services? I have just got wind of a pcn from them and all but I have passed the 28 days as I am still abroad after driving myself to LHR like mentioned previously. 

    They sent a NTK dated the 17/1 with the contravention dated the 14/1 with unauthorized parking as the contravention. Period of parking is 10 mins and 20 seconds. The fine is 100 pounds, the car park they are talking of is Iceland's customer parking lot and was always free. They must have recently taken over as I have never had a fine or had to pay if an Iceland customer. I complained to Iceland as I went in to the store only to find out what I wanted wasnt in stock, hence the period of parking only being 10 mins and they said it was no longer there carpark. What to do?

    Not the same because that's an IPC operator, no appeal worth trying but NO PAYING!

    Start a new thread if you get a court claim for the Euro PS one, and in the mean time find out who runs the retail park and complain to them to cancel it.
