Hi
I have a Parking Charge Notice letter from Parkingeye sent to me today and the amount is £60 to be paid within 28 days otherwise increased to £100.
Is this something I can appeal against as I did park and went to get dessert - this place was owned by restaurant so when checked with them, they said its no longer owned by them so left the car park - overall 7 minutes and did not get any yellow ticket, just this letter. Signage was the same like before, unclear.
Please can anyone advise how I can appeal and if any chances to win this. thanks.

Did you then go and park somewhere else and can prove that (another car park fee receipt)? You need to show POPLA (second stage appeal after you appeal to P/Eye) that the car was parked elsewhere and the driver didn't accept the contract after finding out that the terms had changed (from the restaurant) then reading the signs and leaving immediately.
Is the P/Eye PCN a 'golden ticket' as described in the 3rd post of the NEWBIES thread?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Its not a golden ticket as mentions about "You are notified under paragraph... if the Protection of Freedoms Act 2012 that the driver of the motor vehicle is required to pay this parking charge in full".
I parked elsewhere but it was free parking after 6pm so do not have the receipt unfortunately.
I should say though the signage was small and unclear at night and did not get yellow ticket on windscreen.and duration was only 6 minutes. Any advise would be helpful thanks.0 -
OK, in order to win on signage being unlit at night you need photos taken in the dark, to prove it to POPLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

can I not complain on not being offered 10 minute grace period and the fact that the sign doesn't even mention the fine and also not clear on the user of CCTV camera

The sign has the £100 in a bold black box.
The only useful photo is that entrance photo (the final one) which doesn't tell you it's pay &display or that the terms have changed from when it was the restaurant's car park (free?).
Photos of actual signs should be taken without a flash, because at night you didn't have a torch and had to ask the restaurant to realise the terms had changed.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It's NOT a fine! It's an invoice from a scammer hoping you'll bite.
Can you read those signs? Could you have read them on the night in question without a ladder, torch and magnifying glass?0 -
I will take the pictures again in the dark and complain based on illegible reading of signage. It's difficult to read those signs and that it doesn't mention pay & display too. Will keep you guys posted on how it goes. Thank you0
