    The solicitor is correct though, moving your partner into your home doesn’t create a tenancy therefore they are not a tenant.

    No but I am entitled to occupational rent because they have exclusive use of the property. That was my point.

    If you chose to move out of your own accord and stopped paying the mortgage you don't really have a claim for occupational rent. 

    The presence or not of the new partner isn't all that relevant to that.
