The solicitor is correct though, moving your partner into your home doesn’t create a tenancy therefore they are not a tenant.monty-doggy said:

This is governed by section 24(1)(c) of the Family Law Act or infrequently through section 122(2) of the Courts of Justice Act.

If you chose to move out of your own accord and stopped paying the mortgage you don't really have a claim for occupational rent.monty-doggy said:
