CCJ made by ex boyfriend

Hi, I have a situation where after I asked my ex to move out he started a campaign of harrassement against me and my young daughter, including threats of violence and stalking my daughter on social media over the course of a few years. Police are aware and crime numbers raised against him, otherwise they've done little more than tell him to not approach us. Last week I received a poor credit score notification. Turns out it's a CCJ from him, with no warning letters, etc. I didn't know this was possible for an individual to do this - he's fraudulently demanding over £3k from me (which I don't owe - he still owes me money but I had written it off). I now have 6 years poor credit. I don't know what action to take, has anyone had any success with resolving a similar situation?

    He cannot just have a CCJ awarded.  There needs to be a Letter before Action and a County Court Summons issued.  You need to speak with the court to find out what steps to take next.

    Do you mean he has applied for a CCJ, or one has actually been awarded against you?  If the former, you go to court and contest it. If the former, what is the date is was applied, and why didn't you receive notice of the claim and action? Have you changed address since he moved out?
    Judges award CCJ's, not private citizens.
    Any police action or potential criminal prosecution is not relevant to a civil claim, so don't let the two get intertwined.
    Your credit score is a fictitious number which lenders can't even see, so you can ignore it. What matters is your credit history, and the CCJ.

    You have to ask yourself why have I not received any notification from the courts about this matter.

    He will have made a money claim against you @ MCOL, you should have received a claim pack in the post, setting out the claim against you, it would include a form to file your defence as well.

    Prior to this, a pre-action letter should have been sent, failure to do this may, at a latter stage, invalidate his claim.

    Well if you have not received any of these things, your only option if you want it removing, is to file a set aside motion with the court, information on how to do this can be found here-

    Otherwise, it would be unlikely the ex would escalate this matter any further, if you can live with a CCJ for 6 years, then that would be the cheapest, although not the fairest option.

    Then it's probably been done at a previous address and you should apply for set aside

    No, I didn't say that at all. The score is irrelevant, as it doesn't exist. The CCJ is very serious, and will severely affect your credit eligibility for the next 6 years. as part o your credit history.
    You didn't answer the questions: when was the CCJ awarded, and have you changed address? If the claim was not properly served, you can apply for a set-aside.

  • macman no change of address and nothing received in the post (or by email) and when I rang them they said it was awarded last week.
  • You should apply to have the CCJ set aside. Apart from the impact from your credit score, he can go after you for the money awarded to him.

    You can download the form required from .go.uk and send it to the court.

    I would suggest you also get details of the case, what he sued you for, and how he ensured you did not get anything from the court.
