    Hi all, a date for the hearing has been given for 21 April and I have started compiling the WS and evidence.  Is the WS combined for the defence and counterclaim or is this two separate WS?

    It's a single WS but divided into two sections by a sub-heading half way 'The Part 20 Counterclaim'.

    Perhaps you should study these Civil Procedure Practice Direction Rules because you seem not to have studied, in-depth, the Newbies/FAQ thread, the second post in particular, together with all the advice provided by members here. This is the definitive source:

    Apologies if I have acted inappropriately.  I have read through the Newbies FAQ threads and am adapting the exemplar WS referred to in the thread.  I must have missed the part about separating the Defendant and Counterclaimant witness statements.  I'll go through it again to see what else I've missed.

    You haven't missed anything (except the example WS there by RobertCox is NO LONGER UP TO DATE*).  No-one really tries counterclaims because they almost never succeed and force a case to a hearing, which isn't for the faint-hearted.  Hence there's nothing about counterclaims in the NEWBIES FAQS.
