Financial settlement

Options
Myself and my husband seperated 10 months ago and I’ve since moved out of the family home.

we have a joint mortgage and around £27-30k equity. We’ve agreed a settlement which will be paid by a family member as the husband wants to remain in the house and I’m happy with that. We’ve both got decent pensions and have agreed not to tit for tat. The settlement included jointly held assets such as furniture as I agreed not to take them - I’ve moved in with my partner and didn’t require this.

my question is, we were planning on a gov divorce - can this be done and a consent order done through this process? If so, once the consent order is approved can the settlement be made to me?

We are very amicable as though we seperated 10 months, our marriage was over for quite some time.

I would rather stay amicable and don’t want to spend too much on legal stuff if I don’t have to.

many thanks

You can do the divorce yourselves, just the fee to pay.

With the consent order, get together over a coffee, write out together what you agree and then get a lawyer to write it in legalese, cost about £900 according to a recent post, and submit the order to the court.

That prevent you or ex winning the lottery and facing a bid for a share.

You can do the divorce using the online system on gov.uk.

For the consent order you will need to get this properly drawn up by a solicitor , and will both have to sign the paperwork and to fill in a statement of information (D81) form. Once you have your conditional order of divorce, the agreed financial order can then be uploaded via the court portal for a judge to approve . This is a separate part of the portal from the divorce .

Normally, you don't have to physically go to court, it can all be done on paper and submitted online
