  • You don't get a 'response' to your defence (you know what happens next from the first 12 steps in the NEWBIES thread and not to tell us about the first letter or N180 form - please...).

    The Template Defence thread tells you what arrives next, then the NEWBIES thread 2nd post takes over after that, in the 'IMPORTANT: KNOW WHAT HAPPENS WHEN' section that makes it clear that defence is not the only job,

    Did you get an acknowledgement from the CCBC?
    What I meant was if it looked like whether they were going to discontinue or not.

    Yes, I got an acknowledgement from CCBC immediately after emailing the defence PDF.

    I've bookmarked your IMPORTANT - KNOW WHAT YOU MUST DO AND BY WHEN! post, so I know what to do when N180 Directions Questionnaire arrives.

    I emailed my defence to CCBC and copied in DCB legal on 24th Feb (and received an acknowledgement from CCBC). 

    Today, I have received this letter from the clowns at DCB legal.

    The letter is identical to one sent to another forum member here.

    That's nothing to worry about. The normal process is to send the defence to the CCBC by email and then they will send it to the claimant, but it does no harm to send a copy to the solicitors as well. Just hang on to that letter on the off chance that they later say they never received your defence from the CCBC.

    When you get to the WS stage, then you do send it to DCB L as well as the court you have chosen (not the CCBC).

    When you submitted your defence, did you also send a copy to DCB Legal, even though that is not necessary? If so, then, as @Fruitcake says above, nothing to worry about.

    It has wasted their time dealing with the email, and cost DCB Legal postage.  All good!

    IMHO they are the lowest PCN roboclaim firm.

    It's now been 4 weeks since my Defence was filed with the court on 24th Feb. 

    Any idea on how long it usually takes to receive a Directions Questionnaire?

    Is it up to the Claimant to get the court to issue this, or does it automatically follow on from receiving the Defence?

    The CCBC sent you a letter, or will send you a letter, saying the Claimant has twenty eight days to consider your Defence.
    What you don't know is when the CCBC sent a copy of your Defence to the Claimant. 
    It follows from that that it is not known when the Claimant has to respond to the CCBC. 
    Further, we don't know what delays there are in the CCBC that means they don't send you a Directions Questionnaire as promptly as you might like.
    Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back at the CCBC, remembering to send a copy to the Claimant of course?

    Look after that emailed receipt of your Defence from the CCBC. It may well be useful later.

    I have received a letter (dated 24/03) + completed N180 from DCB legal on Thursday 30th March. There is no sign of N180 having been received by the court (moneyclaim.gov.uk), so I wondered if this is likely just another attempt at them trying to get me to settle out of court?

    Interestingly, I noticed they've used the old (2014) N180 form which doesn't feature the section "Suitability for determination without a hearing."  They've ticked the box for it to be referred to Small Claims Mediation Service.

    For Hearing Venue, they've put "Claimant's Home Court" - I'm assuming they've done this as another form of intimidation, making me think I'd have to traipse all the way to Cheshire, and that instead, I'd settle early.
     
    I have my N180 (updated 2022) form already completed, ready and waiting to send off.

    Just wondering when best to send this?

    Is it okay to email the Court and DCB legal in the same manner as I did with my defence.  Or should I email each separately?

    Aren't your latest questions all answered by items 7, 8, 9 and 10 on that checklist you were following when you filed a Defence?

    Apart from that, didn't this sentence in my post of 24 March at 5:46PM on your thread go some way towards addressing that?...

    You ignore their N180. If yours is ready to go and you've put the correct wording into D1 for NO hearing on the papers and you have not opted for mediation, then as soon as you see on your MCOL history that a DQ has been sent to you, you can send yours. You don't want to file too early and it seems as if the DCB Legal are prompting you to do so by showing you theirs "in anticipation".

    Patience. You are dealing with the intellectually malnourished DCB Legal and you already know how this is likely to end in a discontinuance after they try to contact you for a reduced sum settlement.
