Mirai TV Blew Up In Oct And Still Not Replaced

Options
Hi Everyone,

A Mirai TV I only had for around 9 months blew up on October 2nd. As it was under guarantee I phoned Mirai to arrange for them to collect it and provide a replacement. I was told someone would phone to arrange the collection the next day and they would then look at it to determine if it was fixable or if a replacement was required. I thought that was all fine except nobody phoned the next day or the day after so I phoned them back again and got told there had been some systems failure but it was logged again and someone would definitely phone this time - why they couldn't arrange it themselves I have no idea! To cut a long saga short after several weeks and several more phone calls to their 0870 number I eventually got someone to arrange a collection time for exactly 3 weeks after the TV had blown up via the same number that the others had told me on someone would need to phone me back to arrange that. I thought it was a ridiculous amount of time to wait but at least it was now going to get dealt with.

A few weeks went by after it was collected and I heard nothing from them so I phoned them up and was told by the phone assistant that she didn't know what the delay was but would find out and phone me back within a few hours. Of course no such phone call was forthcoming. So a few days later I again phoned them to get told the same thing and once again not receive the follow-up phone call. I tried one last time to phone them and this time was told that they are waiting on a part for the TV - it must be coming from Mars this part the amount of time it's taking! I was also disconcerted to hear they'd be giving me back the same TV that blew up in the first place. I would have assumed it would be a straightforward swap.

Anyway that was a few weeks ago and I've again heard nothing from them since - it's been nearly 3 months since the TV broke and that's appalling. I'm beginning to think I'll never see this TV again. I've got an address to write a complaint letter to them but was wondering who I would report a failure to fulfill a guarantee to if they don't reply or fix this? Would it be trading standards? Thanks for any help.

Regards

Michelle

You could report them to trading standards and it'd be worth contacting them anyway. But personally I'd be more bothered about doing something to either get the TV back or the money for the TV, i.e. take them to small claims court. A county court judgement against them would carry a lot of weight. But I think TS is your best bet as far as both complaint and advice goes, they may refer you to the TS that covers the juristiction of Mirai's address.

    Hi Superscaper,

Thanks for the advice. I'll send a letter to them recorded delivery and threaten them with trading standards and see if that does the trick. I really wanted to have the TV back by Christmas so it's a complete annoyance.

    Regards

send them a 7 day issue of claim letter byt recorded delivery stating that the delays are unacceptable and that you have been without a tv for the past 3 months - in the cirucumstances you will be claiming interest and expenses incurred for the rip off 0870 number

if they dont reply with a positive response - dont include the still awaiting part then sue for the full amount that you paid for on the on line claim systems through the court web site.

if you need help give me a pm coz i have 6 years legal experience

Could that also technically just mean you've spent 6 years in prison? ;):D

  • you should also maybe consider asking whoever sold you the TV to sort it as they are also liable.

I think thats too late as they have chosen to bypass them and go direct to the manafactuer, in hindsight it would have been better telling the shop first, worth having a word anyway you never know.

    Hi Everyone,

Thanks for all the responses. I hadn't thought of going to the retailer as the one year warranty is a manufacturer's one so I just assumed I would have to deal directly with them.

Anyway I wrote a complaint letter detailing the whole saga and threatened them with Trading Standards and the small claims court. I was going to send it recorded delivery today but I thought I'd send it by fax first just in case I get a quicker response. I wasn't holding out much hope of one but I got a call this morning from them saying they're sending me a brand new TV today by courier to arrive tomorrow. So looks like that did the trick - thanks again.

    Regards
