Boiler Flue installed by non gas-safe builder

New combi boiler was installed by a Gas-Safe engineer but they couldn't install flue as it was raining. A few days later flue was installed by the 'builder' who said the Gas Safe engineer would come back and check it another time. Gas Safe engineer was not present on site during install. Boiler was not capped.
Is this legal?

Has the GS engineer been back to check and if so how long afterwards?
Was there an outlet and the other just adding the top
Had the bolier been commissioned and if so at what point
What are you hoping to acheieve, seek compo, report the GS enginneer, etc?

has the GS person checked it yet?
what do you mean when you say "boiler was not capped"0 -
it depends what you mean by flue. the actual flue, the thick pipe coming out of the boiler, can be installed anytime, as it's internal. it starts at the top of the boiler and it ends flush with the external wall. what might have been installed by your builder is a plume management kit (the black pipe that bolts on to the flue).
while both should be installed by a qualified gas engineer, as long as the flue was installed correctly, I think it's fine. it also depends on what the arrangements were. the gas engineer didn't do anything wrong, he doesn't have to finish the job the same day, so him coming back is not an issue. having said that, he should've told you NOT to use the boiler.
